TERMS OF USE FOR ‘THE GIG’

Introduction

These terms and conditions apply to the use of this website. By using this website, you agree to be bound by these terms and conditions.

In these terms and conditions, “The Gig” means The Gig event produced by CCT Productions Pty Ltd.

i. Amendments to terms and conditions

The Gig reserves the right to amend these terms and conditions from time to time.

Amendments will be effective immediately upon notification on this website. Your continued use of the website following such notification will represent an agreement by you to be bound by the terms and conditions as amended.

ii. Personal use permitted

All copyright and other intellectual property rights subsisting in this website, the contents of this website and the information contained on this website (including the text, graphics, logos, images, audio, video clips, software, digital downloads of this website) are owned or licensed by The Gig and CCT Productions and protected by the laws of Australia and other countries.

Unless The Gig agrees otherwise in writing, you are provided with access to this website only for your personal use. You may print a copy of any information contained on this website for your personal use.

iii. Commercial use prohibited

Unless CCT Productions agrees otherwise in writing, you may not, without CCT Productions written permission:

  • reproduce, store, print or display any part of this website, in any form or by any means, other than for your own personal, non-commercial use;
  • adapt, distribute, publish or create derivative works from, any part of this website, in any form or by any means, for any purpose; or
  • otherwise exploit or commercialise, or attempt to exploit or commercialise, any information, products or services obtained from any part of this website.

iv. Purchase

Where you buy any item that has been made available for sale by The Gig, that transaction is subject to The Gig’s Terms and Conditions of Purchase.

1. TERMS AND CONDITIONS OF PURCHASE

(a) Terms and Conditions. The following terms and conditions (“Terms and Conditions”) apply to:

    1. the purchase of tickets for performances and events at The Gig;
    2. the purchase of tickets for performances or events at any other venue which The Gig or CCT Productions makes available for purchase; and
    3. The inclusion of 1(b) is in addition and does not abrogate your responsibility to comply with the terms and conditions of the other venue.

2. AMENDMENTS TO TERMS AND CONDITIONS

(a) The Gig may vary these Terms and Conditions at any time. The Gig will post the varied Terms and Conditions on its website.

(b) By making a purchase from The Gig, you agree to be bound by the Terms and Conditions as they stand at the time of your purchase.

3. PURCHASE OF TICKETS

(a) All ticket prices for performances, events or products that occur or are provided in Australia are stated in Australian Dollars and include GST where applicable.

(b) Ticket sales for events or products may be subject to limits on the number of tickets a particular person may purchase. The Gig may cancel or refuse to accept orders which it believes are placed in excess of any such limits. This includes orders associated with the same name, email address, billing address, credit card number.

(c) If the amount you pay for a ticket is incorrect, The Gig may cancel that ticket (or the order for that ticket) and refund to you the amount that you paid. This will apply regardless of whether the error arose due to:

  1. an error in a price posted on this website or otherwise communicated to you, or if you are able to order a ticket before its scheduled on-sale or presale date or you are able to order a ticket that was not supposed to have been released for sale; or
  2. a transactional malfunction of The Gig’s operated system.

(d) Tickets for performances, events and products at The Gig are valid only when purchased from The Gig, or from a person authorised by The Gig to sell or distribute tickets. trybooking.com is the official ticket purchasing platform for The Gig.

(e) Tickets may not, without The Gig’s prior written consent, be on-sold at a premium, offered as a prize or inducement, packaged or otherwise used for advertising, promotional or other commercial purposes. The Gig reserves the right to refuse admission to the bearer of any ticket sold or otherwise provided or distributed in breach of this condition.

4. EXCHANGES AND REFUNDS

(a) Performance or event tickets are refundable only if the event or performance to which it relates is cancelled. Performance or event tickets are also refundable if permitted under the LPA Code of Practice for the Ticketing of Live Entertainment Events in Australia. If an event is cancelled or rescheduled:

  1. If the consumer is unable to attend the re-scheduled Event, or if the Event is not rescheduled, the Gig should ensure that the consumer receives a full refund of the Ticket price and other industry imposed Ticket charges.
  2. Consumers should apply for a refund in a timely manner in accordance with this Code and the LPA Complaints Handling and Dispute Resolution Policy and, where possible, before the date of any re-scheduled event. A timely manner is considered to be within five working days of the event.
  3. A consumer will not be entitled to a refund for a cancelled or re-scheduled event if they received a free or complimentary ticket.
  4. During or mid-event, where the event is curtailed by in excess of 50% of the scheduled event time, the Gig may determine that a partial refund may apply, and if so, the consumer should receive compensation that may include a refund of an amount or credit that is reasonable in the circumstances. When considering what is fair and reasonable in the circumstances, the Presenter may have regard to how substantial an amount of the event has been performed.

(b) Performance or event tickets may be exchanged only where expressly permitted by the Presenter. Where exchanges are permitted, they may be subject to certain conditions, and additional fees may also apply.

(c) Under no circumstances will The Gig or Ticketing Service Provider be required to reimburse a consumer for auxiliary expenses incurred by the consumer in his or her attendance, or non-attendance, of a cancelled or re-scheduled event. Auxiliary expenses include, but are not limited to, the cost of travel, car parking, child-care and accommodation. Consumers are encouraged to obtain sufficient ticket or travel insurance cover for such circumstances.

5. CHANGES TO PERFORMANCES

(a) Particulars of the performance or event may be changed without prior notice. Artists or performers may be added, withdrawn or substituted for specific performances. Access to the venue may be restricted without prior notice.

(b) Opening acts or guests may sometimes tour with headlining performers. The Gig is not always made aware of opening acts or the length of their performances. These opening acts are subject to change or cancellation at any time without notice. No refund will be owed if an opening act is changed or cancelled.

6. ADMISSION TO THE GIG AND PERFORMANCES

Admission to The Gig and performances, including the use of your image while in these locations, is governed by our Conditions of Entry (including proof of concession entitlement).

7. ADULT THEMES

The Gig is an all ages event. Please note that performances may include content of an adult nature, and audience discretion is advised.

8. LPA CODE OF PRACTICE

For information regarding ticketing of live entertainment and sporting events, or to obtain a copy of the LPA Code of Practice for the Ticketing of Live Entertainment Events in Australia refer to www.liveperformance.com.au.

Conditions of Entry to The Gig

GENERAL

1. These Conditions of Entry (“Conditions”) apply to your entry and use of The Gig. (“Premises”)

2. You must comply with all lawful requests made by our personnel and all signage in relation to your entry and use of the Premises.

3. We reserve the right to deny entry to or remove any person from The Gig.

RESPONSIBILITY WHILST AT THE GIG

4. When you are on the Premises you are responsible for your own property and behaviour.

5. You must not:

  1. leave bags or personal items unattended;
  2. cause, or permit disruptive behaviour, violence or harassment on or around the Premises;
  3. be intoxicated or under the influence of drugs whilst on the Premises;
  4. smoke indoors, or outside any designated smoking zone
  5. consume food or drink (including alcohol) purchased outside the Premises;
  6. bring animals onto the Premises, unless they are registered assistance animals.

6. Subject to clause 6, we are not responsible for loss suffered by you that was not caused by our negligence or that was not reasonably foreseeable. We are also not responsible for business’ losses (such as lost data, lost profit or business interruptions), loss suffered by non-consumers or any increase in loss that was caused by your breach of these Conditions or your negligence. You agree to release and indemnify us in respect of any claim made against us, as a consequence of, in relation to, or in any way arising out of, your use of the Premises where you breached the law, these Conditions or your conduct is negligent.

ADMITTANCE

7. You must have a valid ticket or entry pass to attend an event or performance and appropriate evidence of entitlement when purchasing a ticket or attending an event or performance with a concession.

8. We reserve the right to:

  1. inspect and search any person and their possessions whilst on the Premises;
  2. deny entry or remove a person from the Premises, without refund, if they refuse to be searched.

USE OF YOUR IMAGE

9. You grant us permission to film, record or photograph you (“Recording”), and to reproduce that Recording in any audio, video, or photographic display or other transmission, exhibition, publication or reproduction in any medium or context for any purpose without further authorisation by, or compensation or attribution to, you.

10. Security cameras may be operating on the Premises and you may be filmed.

REFERENCES

163. In these Conditions, references to:

  1. “We”, “us”, “our” or “The Gig” means The Gig and CCT Productions, and its employees, agents, and independent contractors.
  2. “Premises” includes the The Gig’s fenced area around the Agriculture Pavillion at Orange Showground, Orange NSW and any other venue managed or controlled by The Gig.
  3. “You” or “your” refers to you, or any person with you, including any dependents or children under your supervision.
